1. Introduction & Legal Basis
Nomadical Travel (“we”, “us”, “our”) operates exclusively as a travel consultant and introducer.
We do not act as:
- a tour operator
- a travel agent
- an organiser of travel packages
- a principal in the supply of travel services
Our role is to provide consultancy, ideas, introductions and itinerary inspiration only.
When you choose to proceed with a trip we recommend, your contract will be directly with the Destination Management Company (DMC), tour operator, hotel, airline, or other supplier (“Travel Provider”) responsible for the services.
By engaging with Nomadical Travel, you acknowledge that:
- We do not arrange, combine, contract or sell travel services.
- We do not create or sell “packages” under the Package Travel & Linked Travel Arrangements Regulations 2018 (PTR).
- We act solely as an introducer to third-party Travel Providers.
- All legal and financial responsibility rests with the Travel Provider issuing your booking confirmation.
2. No Packaging or Arrangement of Travel Services
For the avoidance of doubt:
- We do not package travel services.
- We do not combine flights, accommodation, tours or transport into a single product.
- Any itinerary or proposal we provide is for inspiration and guidance only, not a travel package.
- You contract with each Travel Provider independently.
This clause ensures Nomadical Travel is not considered a “package organiser” under PTR.
3. Booking Process
- All bookings, payments and contracts are made directly between you and the Travel Provider.
- We do not take payments, deposits, balances or financial information for any travel services.
- Only the Travel Provider can confirm your booking.
- You must review and agree to the Travel Provider’s Terms & Conditions, including their cancellation, alteration and financial protection policy.
Nomadical Travel has no authority to enter into contracts on your behalf.
4. Financial Protection
- Financial protection (ATOL, ABTA, local bonding or insolvency insurance) is provided solely by the Travel Provider you book with.
- Nomadical Travel does not hold an ATOL licence and does not offer any financial protection scheme.
- We do not guarantee or verify the financial protection status of any Travel Provider.
The Travel Provider’s booking confirmation will detail the protection applicable to your trip.
5. Travel Insurance (Mandatory)
You must obtain comprehensive travel insurance before departure.
This policy should cover:
- cancellation and curtailment
- medical treatment and repatriation
- loss or damage to property
- delays, missed connections and disruption
Nomadical Travel accepts no liability for losses that would reasonably be covered by insurance.
6. Changes, Amendments & Cancellations
- All amendments, cancellations or refund requests must be made directly with the Travel Provider.
- Their Terms & Conditions apply in full.
- Nomadical Travel cannot authorise refunds, issue credits, alter booking terms or override supplier policies.
We will assist with communication where helpful, but we hold no contractual authority.
7. Information, Itineraries & Accuracy
All itineraries, images, descriptions and recommendations we provide are based on information supplied by third-party providers at the time of communication.
We make reasonable efforts to ensure accuracy, but:
- local conditions may change
- suppliers may amend schedules or availability
- pricing may fluctuate
Nomadical Travel is not responsible for variations, errors, cancellations or changes made by third-party suppliers.
8. Limitation of Liability
Nomadical Travel acts solely as an introducer.
We:
- accept no liability for the acts, omissions or failures of any Travel Provider
- are not responsible for injury, loss, damage, delay or irregularity caused by third parties or force majeure
- do not warrant the suitability, safety, reliability or performance of any Travel Provider
To the maximum extent permitted by law, our total liability shall never exceed the value of any consultancy fees paid directly to us (if applicable).
9. Your Responsibilities
You are responsible for:
- ensuring all travellers hold valid passports, visas and entry documents
- meeting health, vaccination and entry requirements
- complying with the Travel Provider’s Terms & Conditions
- arriving on time for flights, transfers and activities
- purchasing suitable travel insurance
- reviewing your booking confirmation for accuracy
Nomadical Travel is not liable for issues arising from failure to meet these obligations.
10. Force Majeure
We cannot accept liability or pay compensation for events beyond our control or that of our partners, including:
- natural disasters
- epidemics or health emergencies
- political or civil unrest
- strikes or industrial action
- severe weather
- changes imposed by local authorities
These events fall outside the scope of Nomadical Travel’s responsibility.
11. Complaints
If you encounter an issue during your trip, you must report it immediately to the Travel Provider so it can be resolved locally.
Nomadical Travel will assist where possible but has no contractual liability for resolving complaints or disputes.
12. Data & Privacy
We comply with UK GDPR.
Your data is used only to:
